Gymnasia Terms and Conditions

These Terms and Conditions form a public offer agreement for the services provided by Lisi Sports LLC, identification number 405489118, operating under the Gymnasia name. Gymnasia can be contacted at info@gymnasia.com. Legal address: Georgia, Tbilisi, Vake-Saburtalo district, village of Kvemo Lisi. Actual service location: 14a E. Amashukeli Street, Tbilisi, Georgia.

These terms apply to Gymnasia facilities, classes, memberships, day passes, free trials, the Gymnasia website at gymnasia.ge, and the Gymnasia mobile application for iOS and Android.

By paying for a service, creating or using an account, booking a class, using a Gymnasia pass, or electronically accepting these terms in the app or website, the customer accepts this public offer agreement.

1. Terms Used In This Agreement

"Gymnasia" means Lisi Sports LLC and the Gymnasia facilities, website, mobile application, staff, coaches, and service systems. "Customer" or "member" means any person who buys, books, receives, attends, or uses Gymnasia services. For minors, the customer also includes the parent or legal guardian who creates the account, pays, signs, books, or gives consent on the minor's behalf.

2. Services, Schedule, And Access

Gymnasia provides sports, fitness, martial arts, wellness, class, personal training, facility access, and related services according to the current service list, prices, membership plan, and class schedule. The current schedule and service information may be published at the facility, on gymnasia.ge, and in the Gymnasia app.

3. Memberships, Payments, And Renewals

Prices are shown in Georgian lari unless stated otherwise. Services are personal to the customer and may not be transferred, resold, shared, or used by another person unless Gymnasia explicitly allows it.

4. Class Booking, Cancellation, And Attendance

Customers may book eligible classes through the app, website, reception, or other approved channels. Booking is subject to available capacity, membership eligibility, age rules, coach requirements, and the actual state of Gymnasia's booking systems.

5. Digital Pass, App Account, And Device Access

The Gymnasia app may provide account access, digital membership pass, NFC or wallet pass, class booking, membership information, payment status, family features, notifications, and support tools.

6. Minors, Family Accounts, And Guardian Consent

Customers under 18 may receive services only with the permission and responsibility of a parent or legal guardian and, where required, with coach or instructor participation. Gymnasia may require the parent or guardian to create an account, link a child profile, sign these terms, approve data processing, and manage bookings or payments on the child's behalf.

By accepting these terms for a minor, the parent or legal guardian confirms that they have authority to do so, have reviewed the risks in Section 7, permit the child to participate in the selected activities, and will explain that the child must follow coach and facility rules.

7. Health, Safety, And Facility Rules

Physical exercise, martial arts, fitness training, sauna, pool, ice bath, and similar activities involve risk. By using Gymnasia services, the customer confirms that they are medically able to participate or have consulted a qualified medical professional where needed.

Before each training session, the member or customer, and for a minor the parent or legal guardian, is responsible for making a reasonable assessment, based on symptoms, known medical conditions, injuries, medical advice, and information reasonably available to them, that the participant can safely take part. A participant must not attend or take part while they have a fever, an acute or potentially contagious illness, significant pain or injury, dizziness, breathing difficulty, or another known condition or restriction that may make exercise unsafe. The member, parent, or guardian must promptly inform Gymnasia and the coach of relevant known restrictions and obtain medical advice or clearance when reasonably needed. This responsibility does not require them to identify unknown or hidden conditions and does not reduce Gymnasia's duties of reasonable care, safe premises, appropriate instruction and supervision, or emergency response.

Inherent risks include falls, collisions, physical contact, contact with equipment or surfaces, bruises, cuts, strains, sprains, fractures, concussion, aggravation of an existing condition and, rarely, serious injury. Some inherent risks remain even when reasonable rules, instruction, and supervision are followed. The customer, and a parent or guardian signing for a minor, acknowledges and accepts these inherent risks. This acknowledgement does not waive any right or exclude any responsibility that cannot lawfully be waived or excluded.

8. Locker Rooms, Personal Items, And Lost Property

Customers are responsible for their personal belongings. Lockers are provided for temporary use during training and must be emptied after use. Gymnasia is not responsible for loss, theft, or damage to personal items except where mandatory law provides otherwise.

Items found at Gymnasia may be stored for a limited period and then disposed of if not claimed.

9. Personal Data, Privacy, And Separate Consents

Gymnasia processes personal data to create and manage accounts, provide memberships, bookings, passes, payments, attendance, family features, support, safety, security, legal compliance, service improvement, and communications. Data may include name, surname, phone number, email, date of birth, sex, identification or membership data, payment status, booking and attendance data, device identifiers, app usage data, support information, profile photo, and other information provided by the customer or required to provide services.

Gymnasia's Privacy Policy explains how personal data is collected, used, stored, shared, and deleted. It is available at gymnasia.ge/policies/privacy-en. By accepting these terms, the customer acknowledges the Privacy Policy. Where a separate consent is required by law or product flow, Gymnasia may request it separately, including for a child profile, direct marketing, promotional photo or video use, push notifications, or special-category data.

10. Photo, Video, Audio, And Security Monitoring

Gymnasia may use photo, video, and audio monitoring in and around the facility for security, safety, access control, property protection, dispute investigation, service quality, and legal purposes. Gymnasia will place notices where required.

Promotional use of a customer's identifiable image, voice, or story will be handled according to the Privacy Policy and any separate consent requested by Gymnasia.

11. Notifications And Communications

Gymnasia may contact customers by phone, SMS, email, push notification, messaging app, or in-app message about account security, OTP login, class bookings, schedule changes, reminders, membership status, payment, support, service updates, and legal notices. Marketing messages may be subject to separate consent or opt-out options.

12. Account Deletion And Data Requests

Customers may request account deletion through the app or by contacting Gymnasia. Some records may be retained where required for accounting, legal, safety, dispute, fraud-prevention, membership, or audit purposes. If automated deletion cannot be completed, Gymnasia may request identity verification and complete the process manually.

13. Liability And Property Damage

The customer is responsible for property damage caused to Gymnasia, other customers, staff, or third parties by the customer's intentional, negligent, unsafe, or rule-breaking conduct. Gymnasia may document damage and request reimbursement according to law.

No reimbursement is due for an ordinary accident that occurs while a customer or child is performing a coach-assigned exercise during class and following the coach's instructions, unless the damage also results from intentional, reckless, negligent, unsafe, or rule-breaking conduct. No reimbursement is due for normal wear and tear, a hidden or pre-existing defect, equipment failure, inadequate Gymnasia supervision, or damage caused by Gymnasia. If more than one party contributed to the damage, responsibility will be reduced proportionately as required by law.

Where reimbursement is legally due, the amount is the lower of the documented, direct, and reasonable repair or replacement loss and the following standard maximum. Age, condition, repairability, and salvage value will be taken into account:

Gymnasia will give the customer or guardian an incident description and reasonable supporting evidence, such as photographs and a repair quote or invoice, and an opportunity to respond. A disputed amount will not be automatically deducted from prepaid services or a saved payment method. Liability for damage caused by a minor, and any responsibility of a parent, guardian, or person responsible for supervision, is determined under applicable Georgian law; these terms do not create liability beyond that law.

Gymnasia is not responsible for harm caused by a customer's failure to follow safety rules, coach instructions, medical advice, or facility rules, or by third-party actions, except where mandatory law provides otherwise. Nothing in these terms excludes or limits Gymnasia's responsibility for its own intentional conduct, gross negligence, unsafe premises, inadequate supervision, or any other responsibility that cannot lawfully be excluded.

14. Suspension, Termination, And Refusal Of Service

Gymnasia may suspend access, cancel bookings, refuse service, or terminate a membership where a customer breaches these terms, violates safety or facility rules, misuses a pass, fails to pay, provides false information, behaves aggressively, creates risk to others, or abuses app or website systems.

15. Changes To These Terms

Gymnasia may update these terms from time to time. The current version will be published on gymnasia.ge and may be shown in the Gymnasia app. If Gymnasia considers a change material, the app or website may require the customer to review and electronically accept the updated version before continuing to use certain services.

16. Force Majeure

Gymnasia is not responsible for failure or delay caused by circumstances outside its reasonable control, including natural disasters, fire, flood, war, government restrictions, public health measures, power or communications outage, road closure, utility failure, emergency, payment provider outage, or third-party platform failure.

17. Governing Law And Disputes

These terms are governed by the laws of Georgia. The parties will first try to resolve disputes through negotiation. If negotiation fails, the dispute may be submitted to the competent court in Tbilisi, Georgia, unless mandatory law provides another forum.

18. Language

These terms are available in English, Georgian, and Russian. If a translated version differs from the Georgian version, the Georgian version controls unless mandatory law requires otherwise.
